Our client, a minor at the time, embarked on a complex journey to secure British citizenship. He initially entered the UK as a PBS Child Dependent accompanying his mother, who held a Tier 1 (Investor) Visa. His visa remained valid until October 2018, at which point the family faced unexpected challenges.

When the family applied for Indefinite Leave to Remain (ILR), their application was refused. They promptly filed for an administrative review, yet the decision remained pending for an extraordinary three-year period, leaving their status in limbo.

By 2021, with their immigration status still unresolved, the Child Applicant and his mother sought our legal assistance. Given that the Child Applicant had lived in the UK for seven years as a minor, we argued that their removal would be disproportionate and contrary to the best interests of the child. This resulted in the family being granted discretionary leave under the 10-year settlement route.
